Wir st\u00fctzen uns dabei sowohl auf Forschungsartikel als auch auf dokumentierte Erfahrungen von Praktikern. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Der erste Artikel der Reihe befasst sich mit der Anwendung von Aufstellungen im Rechtssystem. \"Organisationsaufstellungen in Wirtschaft und Management\" und \"Die Aufstellungsmethode in der psychischen Gesundheit und im Gesundheitswesen\" folgen in K\u00fcrze. <\/span><\/p>\n<h2>Konstellationen im Rechtssystem<\/h2>\n<p><a href=\"https:\/\/belong.ee\/de\/konstellationen\/\"><span style=\"font-weight: 400;\">Familienaufstellungen<\/span><\/a><span style=\"font-weight: 400;\"> (eine von Bert Hellinger entwickelte systemische Therapiemethode) und ihre Weiterentwicklungen, zu denen auch Organisationsaufstellungen geh\u00f6ren, wurden in den letzten Jahren in vielen Bereichen auf der ganzen Welt angewendet.<\/span><\/p>\n<p><b>Argentinien (Provinz Mendoza):<\/b><b><br \/><\/b><span style=\"font-weight: 400;\">Im Jahr 2023 erregte ein Friedensrichter in der Provinz Mendoza in Argentinien Aufmerksamkeit, weil er bei Familienproblemen alternative Methoden des \"systemischen Rechts\" anwandte. So wies er zum Beispiel Eltern, die die Schule schw\u00e4nzten, an, statt der \u00fcblichen Strafen an reflektionsbasierten Workshops (einschlie\u00dflich Biocodierung) teilzunehmen. <\/span><a href=\"https:\/\/www.tiempoar.com.ar\/ta_article\/biodescodificacion-y-constelaciones-un-codigo-de-epoca-que-llego-a-la-justicia\/#:~:text=Una%20jueza%20de%20paz%20de,derecho%20y%20el%20%C3%A1mbito%20jur%C3%ADdico\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">[1]<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Dieser Ansatz f\u00fchrte zu bemerkenswerten Ergebnissen - es wird gesch\u00e4tzt, dass die Kinder in etwa 80 % der F\u00e4lle erfolgreich in die Schule reintegriert wurden, w\u00e4hrend Geldstrafen nichts n\u00fctzten. <\/span><a href=\"https:\/\/www.tiempoar.com.ar\/ta_article\/biodescodificacion-y-constelaciones-un-codigo-de-epoca-que-llego-a-la-justicia\/#:~:text=%E2%80%9CEn%20algunas%20contravenciones%20y%20seg%C3%BAn,como%20opci%C3%B3n%3A%20la%20persona%20puede\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">[1]<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Obwohl dieser Richter vor allem Biocoding (Erschlie\u00dfung der Zusammenh\u00e4nge zwischen emotionalen Mustern und Krankheit) und Biodanza (K\u00f6rperarbeit und Bewegungstherapie) einsetzte, ist dies Teil eines umfassenderen Trends: Alternative systemische Praktiken, einschlie\u00dflich Familienaufstellungen, sind im Rechtssystem zunehmend pr\u00e4sent. In Argentinien wurde sogar der Begriff \"systematisches Recht\" (spanisch: \"systematische Gerechtigkeit\") eingef\u00fchrt. <\/span><i><span style=\"font-weight: 400;\">Derecho Sist\u00e9mico<\/span><\/i><span style=\"font-weight: 400;\">), der sich auf die Anwendung der Grunds\u00e4tze des Familienstellens in der Rechtspraxis bezieht. <\/span><a href=\"https:\/\/www.tiempoar.com.ar\/ta_article\/biodescodificacion-y-constelaciones-un-codigo-de-epoca-que-llego-a-la-justicia\/#:~:text=El%20Derecho%20Sist%C3%A9mico%20tiene%20que,casos%20de%20herencias%20o%20divorcios\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">[1]<\/span><\/a><span style=\"font-weight: 400;\">. <\/span> <\/p>\n<p><span style=\"font-weight: 400;\">Die Universit\u00e4t La Plata hat einen Diplomstudiengang \"Rechtscoaching und Systemisches Recht\" ins Leben gerufen, der sich an Juristinnen und Juristen im Jahr 2020 richtet und in dem gelehrt wird, wie man Streitigkeiten mithilfe von Familienaufstellungen l\u00f6st. <\/span><a href=\"https:\/\/www.tiempoar.com.ar\/ta_article\/biodescodificacion-y-constelaciones-un-codigo-de-epoca-que-llego-a-la-justicia\/#:~:text=%E2%80%9C%C2%BFCu%C3%A1ntas%20veces%20un%20juez%20dicta,del%20Este%2C%20en%20La%20Plata\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">[1]<\/span><\/a><span style=\"font-weight: 400;\">. Ein Richter dort <\/span><b>Sami Storch<\/b><span style=\"font-weight: 400;\"> hat bereits 2006 damit begonnen, die Hellinger-Methode in familienrechtlichen F\u00e4llen im Bundesstaat Bahia anzuwenden und wurde zu einem Pionier der Bewegung f\u00fcr \"systemisches Recht\". <\/span><a href=\"https:\/\/rsdjournal.org\/index.php\/rsd\/article\/view\/20527#:~:text=research%20that%20investigates%20the%20performance,United%20Nations\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">[2]<\/span><\/a><span style=\"font-weight: 400;\">. <\/span> <\/p>\n<p><span>Bis 2012 wurde der Einsatz von Familienaufstellungen an brasilianischen Gerichten offiziell eingef\u00fchrt, insbesondere bei der Vermittlung in F\u00e4llen von h\u00e4uslicher Gewalt und Sorgerecht. <\/span><a href=\"https:\/\/www.skeptic.org.uk\/2022\/04\/family-constellation-the-pseudoscience-retraumatising-victims-at-the-approval-of-brazilian-courts\/#:~:text=Family%20Constellation%2C%20ostensibly%20a%20form,for%20Integrative%20and%20Complementary%20Medicine\" target=\"_blank\" rel=\"noopener\"><span>[3]<\/span><\/a><span>. Storch erzielte ein bemerkenswertes Ergebnis - fast alle Konflikte wurden durch eine Einigung der Parteien unter Anwendung der systemischen Hellinger-Prinzipien gel\u00f6st. <\/span><a href=\"https:\/\/www.theknowingfield.com\/tkf29#:~:text=Sami%20Storch%3A%20Family%20Constellations%20by,revolutionise%20the%20Brazilian%20Justice%20System\" target=\"_blank\" rel=\"noopener\"><span>[4]<\/span><\/a><span>. <\/span> <\/p>\n<p><span style=\"font-weight: 400;\">Sein innovativer Ansatz wurde 2014 mit dem Preis des brasilianischen Justizausschusses ausgezeichnet, der die Anwendung von systemischen Regelm\u00e4\u00dfigkeiten wie 'Liebesroutinen' auf die Justizverwaltung w\u00fcrdigt.\" <\/span><a href=\"https:\/\/www.theknowingfield.com\/tkf29#:~:text=Justice%20System\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">[4]<\/span><\/a><span style=\"font-weight: 400;\">. In der Praxis bedeutet das, dass als Teil des Gerichtsverfahrens <\/span><b>eine Aufstellungssitzung<\/b><span style=\"font-weight: 400;\">in der Parteien und Freiwillige in Rollen schl\u00fcpfen, um die tieferen famili\u00e4ren und psychologischen Muster des Konflikts ans Licht zu bringen. Dieser Ansatz hat sich zum Beispiel bei Scheidungs- und Vormundschaftsstreitigkeiten bew\u00e4hrt, bei denen ein herk\u00f6mmlicher Prozess den Konflikt nur noch versch\u00e4rfen w\u00fcrde. <\/span><a href=\"https:\/\/www.theknowingfield.com\/tkf29#:~:text=%E2%80%9CMr,Constellation%20in%20your%20daily%20work%3F%E2%80%9D\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">[4]<\/span><\/a><span style=\"font-weight: 400;\">. <\/span> <\/p>\n<p><span style=\"font-weight: 400;\">Obwohl mehrere brasilianische Richter \u00fcber positive Ergebnisse berichtet haben (schnellere Einigung, bessere Zusammenarbeit im Sinne des Kindeswohls usw.), hat dieser Ansatz auch Kontroversen ausgel\u00f6st. <\/span><b>Kritikerinnen und Kritiker<\/b><span style=\"font-weight: 400;\"> - darunter Akademiker\/innen und Fachleute f\u00fcr Opferhilfe - warnen davor, dass die obligatorische Anwendung von Familienaufstellungen vor Gericht eine retraumatisierende Wirkung auf die Opfer haben kann. So gab es zum Beispiel F\u00e4lle, in denen eine Frau, die h\u00e4usliche Gewalt erlitten hat, zu einer <\/span> <i><span style=\"font-weight: 400;\">Konstellation<\/span><\/i><span style=\"font-weight: 400;\"> mit ihrem misshandelnden Partner konfrontiert und sogar ermutigt wurde, ihrem Missbraucher zu \"vergeben\" - eine Situation, die f\u00fcr das Opfer extrem traumatisch sein kann. <\/span><a href=\"https:\/\/www.skeptic.org.uk\/2022\/04\/family-constellation-the-pseudoscience-retraumatising-victims-at-the-approval-of-brazilian-courts\/#:~:text=forced%20to%20relive%20her%20trauma%2C,on%20in%20Brazil%20since%202012\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">[3]<\/span><\/a><span style=\"font-weight: 400;\">.
